SC issued notice to WB govt on plea of CBI/SIT investigation into post-poll violence

The Apex Court, while hearing a petition which sought for CBI (Central Bureau of Investigation)/SIT (Special Investigation Team) investigation into the killings of two BJP workers which took place during post-poll violence in West Bengal, issued notice to the West Bengal state government.

In the petition, it was alleged that the BJP workers were killed by the members of Trinamool Congress on the day the assembly election results were announced i.e. on May 2. The petition had been moved by the brother of one of the deceased BJP worker and wife of the other.

The petitioners sought for the constitution of SIT to investigate the case under the constant monitoring of the court. Apart from this, the petitioners also sought for an investigation into the widespread violence which took place in West Bengal after TMC was elected to power.

The counsel appearing for petitioners had submitted before the court that the West Bengal police had not taken any action against the brutal murders and assaults which had taken place post-poll. The counsel also highlighted that there have been attempts of subverting the investigation.

The counsel also submitted that due to inaction on part of state police, there is a dire requirement of court to monitor the investigation. The counsel also prayed for video-recording of post-mortem of one of the deceased, who had not been cremated so far.

However, the bench stated that it could not consider the above stated prayer ex-parte.

The same issue of police inaction had been brought before the High Court of West Bengal by a group of lawyers’ who alleged that a considerable population of West Bengal had been subjected to physical assault, sexual assault, theft after TMC had been declared as a winner of assembly elections.
