Ensure timely supply of Remdesivir drug to COVID-19 patients- Bombay HC

The Bombay High Court directed the State to ensure that the Covid-19 patients are not forced to run from pillar to post for the anti-viral drug Remdesivir and that the same is made available to the patients at the respective hospital or COVID Centre.

The bench asked the State to smoothen the supply of drug through a helpline number which should be operational 24/7 for the citizens.

The bench comprising of Chief Justice of Bombay asked the State to appoint requisite staff for running this facility of helpline number and supplying the drug at the required hospital or COVID Centre.

These directions had been made while hearing a PIL filed by the COVID management in the State. The PIL highlighted the shortage of Remdesivir, oxygen supply, problems relating to bed management, and relating to RT-PCR and Rapid Antigen tests.

The bench also upheld the liability of citizens’ and stated that their neglectful behaviour contributed to the second wave of COVID-19.

The bench went on to emphasize that every citizen having a legal right has a corresponding legal duty. If the citizens would’ve been careful, the complications won’t have occurred and the country as a whole could arrest the spread of the pandemic.

The bench stated that it is high time that the citizens’ realize their obligation towards the society and refrain themselves from indulging in any activity that might lead to further increase in the number of cases of this deadly virus.

The bench also accepted the recommendation of petitioner that the State must grant permission to more laboratories collecting samples and conducting the tests.

Through this PIL, the bench gave a number of directions to Maharashtra which could smoothen the COVID-19 management system and arrest the spread of virus.
