In a PIL seeking establishment of Transgender Welfare Board and Committee to investigate ross abuse against the transgender people, the Supreme Court issues notice.

In a recent PIL filed in the Supreme Court seeking the establishment of the Transgender Welfare Board to address social welfare issues of a trans person and to appoint a standing committee in order to investigate reports of abuse against trans person by the police. In the pleas, it was submitted that the trans people have to suffer and face many problems in the matters of housing, health, education and employment and thereby, they deprive them of social cultural participation.

The discrimination suffered by them emanated from the social stigma and isolation that they suffer from lack of resource which were provided for transgender people. The transgender community faces stigma and discrimination and therefore has fewer opportunities as compared to others. They also submitted that living without fear of discrimination and violence and being supported and affirmed in being who they are is critical for allowing transgender people to love healthy, safe and fulfilling lives.

The pleas further submitted that India’s parliament passed a bill 2019 to protect transgender rights, but the new law is inadequate on several fronts. Trans activists and allied human rights have critiques the various trans rights bills since the first one was introduced in 2016. In the end, lawmakers failed to consider the concerns the activists raised. As a result, India’s new law will violate the rights of trans people rather than respect and uplift long-persecuted communities.

Due to al the above reasons, the PIL requests for establishment of the transgender welfare board to understand and address the welfare issues of the trans people and for the appointment of the standing committee which would comprise of the station house officers and the human and social rights activists to promptly investigate reports of gross abuse by the people against trans persons. For this, the Supreme Court issued a Notice.
